    This bill modifies the National Environmental Policy Act (NEPA) approval process for tribal transportation safety projects to categorically exclude qualifying projects from requirements to conduct environmental assessments and environmental impact statements. A tribal transportation safety project is one that is eligible for assistance under the tribal transportation program and that (1) corrects or improves a hazardous road location or feature, or (2) addresses a highway safety problem. The Department of the Interior must (1) review existing Federal Highway Administration categorical exclusions to determine applicability to tribal transportation program projects, and (2) identify tribal transportation safety projects that meet general categorical exclusion requirements. Interior must establish categorical exclusions for tribal projects consistent with its findings. The bill prescribes requirements for the expedited review and approval of tribal transportation safety projects under NEPA or other federal laws. Interior must enter into five-year programmatic agreements with Indian tribes that establish efficient administrative procedures for carrying out environmental reviews for tribal transportation program projects. An agreement may allow a tribe to determine whether a project is categorically excluded from the preparation of an environmental assessment or impact statement under NEPA.

Among other things, the bill * reauthorizes several transportation programs from FY2021-FY2025, including the federal-aid highway program and the transportation infrastructure finance and innovation program; * increases funding for tribal and federal lands transportation programs; * provides for a bridge investment program to award competitive grants to certain governmental entities for projects that improve the condition of bridges, and the safety, efficiency, and reliability of the movement of people and freight over bridges; * requires the Department of Transportation to encourage each state to develop a voluntary plan that provides for the immediate and long-term personnel and workforce needs of the state to deliver transportation and public infrastructure projects; * establishes a two-year goal for the completion of environmental review with respect to highway projects and a 90-day timeline for related project authorizations; * sets forth several new climate-related grant programs, including for resiliency, carbon reduction, charging and refueling, alternative road user fees, carbon capture, and diesel emissions; * expands the flexibility and eligible uses of formula funds provided out of the Highway Trust Fund; * prioritizes the research and development of animal detection systems that reduce the number of wildlife-vehicle collisions; and * expedites environmental reviews for tribal transportation safety projects.

Per the bill, Customs and Border Protection may transfer funds to the BIA to maintain or repair roads in certain situations. The bill requires the Department of Transportation to develop best practices and a standardized form in relation to motor vehicle crash data on certain tribal lands.

    This bill establishes the Forest Service Legacy Roads and Trails Remediation Program. Specifically, under the program, the Forest Service shall * carry out critical deferred maintenance, urgent repairs, road and trail relocation, and associated activities on National Forest System roads, trails, and bridges; * restore passages of fish and other aquatic species by removing or replacing unnatural barriers from such passages; and * decommission any roads and trails as unneeded as soon as practicable after identifying them as unneeded. In implementing the program, the Forest Service shall give priority to projects that protect or restore * water quality and watershed function; * a watershed that supplies a public drinking water system; * the habitat of a threatened, endangered, or sensitive fish or wildlife species, or a species of conservation concern; or * a watershed for which the Forest Service has completed a watershed protection and restoration action plan. The Forest Service shall identify the minimum road system needed for each unit of the National Forest System. The Forest Service shall develop a national strategy to carry out the program.

    Highway-Rail Grade Crossing Safety Act of 2019 This bill addresses highway-rail grade crossing safety. The bill reauthorizes the highway safety improvement program through FY2024, with $50 million set aside in FY2020-FY2024 for the Railway-Highway Crossings Program. Eligibility requirements are revised for the award of capital grants to states under the rail line relocation and improvement program. The Federal Railroad Administration (FRA) must hire * 16 full-time grade crossing safety managers to work with state and local officials to identify safety improvements to highway-rail grade crossings; and * 8 trespass prevention managers to work with local governments, schools, businesses, and railroads to develop site-specific mitigation plans. The Department of Transportation must gather and publish information and statistics relating to highway-rail grade crossing problems, including from studies conducted by the FRA, rail carriers, and independent entities.

    Tribal Transportation Equity and Transparency Improvement Act of 2020 This bill revises certain programs related to tribal transportation. First, the bill revises the Tribal Transportation Program (TTP) by directing the Department of the Interior to (1) request proposals from Indian tribes to include additional transportation facilities in the National Tribal Transportation Facility Inventory, and (2) ensure that all nonconfidential information from the inventory is made available on its website. Next, the bill specifies that funding allocations (i.e., tribal shares) under the TTP must be determined using the facility inventory for the most recent fiscal year for which data is available instead of using FY2012 data. It also requires each Indian tribe that intends to include a proposed road in the inventory to complete and submit certain documentation for the road. It also requires independent audits by the inspectors general of Interior and the Department of Transportation, as well as the Government Accountability Office, to review the administration of the TTP. Additionally, the bill permits Indian tribes to use funds for carrying out highway safety programs in cooperation with states, counties, and other local subdivisions. It also increases the federal share for Indian tribes under the Nationally Significant Federal Lands and Tribal Projects Program and allows Indian tribes to use planning and design funds for grant applications under the program. Finally, the bill establishes the Tribal Transportation Advisory Committee, which must provide advice to Interior and study issues related to tribal transportation.
