The Department of the Treasury shall impose asset-related sanctions on persons that knowingly provide significant financial services to any person that is subject to various sanctions, including those covered in any United Nations Security Council (UNSC) resolution. The President may impose sanctions on persons that take certain actions related to North Korea, including knowingly (1) engaging in transactions in goods such as coal, or (2) contributing to a violation of a UNSC resolution through a significant transfer of property. A country that has transacted in defense articles with North Korea shall be barred from receiving certain U.S. assistance for five years, whereas currently the prohibition lasts for two years. The President's annual report to Congress on the implementation of UNSC resolutions shall include information on countries that fail to prohibit certain activities related to North Korea, such as the unauthorized clearing of funds. The bill also imposes various reporting requirements, such as requirements for Treasury to report on how North Korea's government exploits beneficial ownership rules to access the international financial system. The bill authorizes each state to adopt measures to require the divestment of the state's assets from North Korea-related investments. Treasury shall designate an office to coordinate efforts to combat the illicit financing of human trafficking. The Interagency Task Force to Monitor and Combat Trafficking shall report to Congress recommendations for strengthening anti-money-laundering efforts in relation to human trafficking.No Unconstitutional War Against North Korea Act of 2020

The Department of the Treasury shall restrict correspondent and payable-through accounts that are used to facilitate significant transactions or provide services to sanctioned entities, specifically North Korean financial institutions, companies, and certain North Korean individuals, such as those named in certain executive orders. (Correspondent and payable-through accounts are often maintained by foreign financial institutions in U.S. banks to access the U.S. financial system.) Treasury shall use its vote and voice in international financial institutions, such as the International Monetary Fund (IMF), to oppose the provision of assistance by such institutions to governments that fail to enforce the sanctions provided under this bill. The Export-Import Bank may not guarantee, insure, or extend credit in relation to exports to entities sanctioned under this bill. Treasury shall support increasing use of the IMF administrative budget for technical assistance to help IMF members fight money laundering and funding for terrorism. Various sanctions and restrictions under this bill shall be suspended if the President certifies to Congress that (1) North Korea has committed to suspending its weapons of mass destruction programs and engaging in multilateral talks on limiting such programs, or (2) it is in U.S. national security interests to do so.Calling upon the leadership of the Government of the Democratic People's Republic of Korea to dismantle its labor camp system, and for other purposes.

Individuals engaging in prohibited conduct may be subject to civil and criminal penalties, including imprisonment. The President shall impose sanctions on entities that knowingly transfer crude oil to North Korea or to an affiliated entity. The Department of State shall report on U.S. efforts to pressure North Korea, including a list of countries that are uncooperative with such efforts. The State Department may (1) alter U.S. diplomatic relations with such countries, such as by reducing engagement; and (2) reduce foreign assistance to such countries. The President must make certifications to Congress before (1) removing certain persons from a blocked persons list maintained by the Office of Foreign Asset Control, or (2) terminating North Korea's designation as a jurisdiction of primary money laundering concern. The Department of Homeland Security may require enhanced screening procedures for cargo originating from a country of concern with respect to evading sanctions against North Korea. The bill calls for briefings and reports on various topics, including (1) North Korea's use of rocket fuels for its ballistic missiles, (2) Russian efforts to block United Nations sanctions against North Korea, and (3) businesses and countries that employ North Korean laborers.Recognizing the 100th anniversary of the March First Movement and Korea's declaration of independence from the Empire of Japan.
