    National Institute of Manufacturing Act This bill establishes the National Institute of Manufacturing to serve as the central hub for federal manufacturing programs, and it directs the institute to coordinate such programs across agencies through a national strategic plan for manufacturing. The institute shall, among other things, (1) convene key stakeholders to develop a national strategic plan for manufacturing in the United States that identifies the needs and priorities of the U.S. manufacturing sector; (2) support and incentivize manufacturing-focused research, collaboration, and education; and (3) be the primary federal entity for all decisions related to manufacturing. Overseen by a Chief Manufacturing Officer, the institute shall be composed of various directorates (e.g., a Directorate for Technology Development and a Directorate for Trade), and the functions of specified federal manufacturing programs and offices shall be transferred to the institute and its directorates. The bill also permanently reauthorizes the U.S. Manufacturing Council of the International Trade Administration as the National Manufacturing Council, and it tasks the council with (1) ensuring regular communication between the federal government and the U.S. manufacturing sector, (2) advising the institute's Chief Manufacturing Officer on government policies and programs that affect U.S. manufacturing, and (3) ensuring the U.S. remains the leading destination for investment in manufacturing throughout the world. Lastly, the bill requires the Chief Manufacturing Officer to establish themanufacturing.gov hub, a section of the Department of Commerce's website that shall serve as the primary point for information relating to every federal manufacturing program.

Such study shall involve, among other things, (1) outreach to manufacturers to review internet-connected devices and solutions used in the manufacturing industry and their impact on the manufacturing process, (2) establishing a list of federal agencies asserting jurisdiction over industry sectors that rely on manufacturing and internet-connected devices and solutions used in manufacturing, and (3) surveying the marketplace and supply chain of internet-connected devices used in manufacturing to assess and identify risks and trends in such marketplace and supply chain. Commerce must report to Congress the results of such study and any recommendations to promote the use of internet-connected devices and solutions in manufacturing.

    Global Leadership in Advanced Manufacturing Act of 2019 This bill expands the scope of the Network for Manufacturing Innovation program, makes changes to the funding design for the centers for manufacturing innovation, and directs interagency collaboration to develop national certifications for advanced manufacturing workforce skills. The Network for Manufacturing Innovation program established a nationwide network of centers for manufacturing innovation, each of which has a unique technological concentration. The bill expands the definition of acenter for manufacturing innovationto make eligible for inclusion in the program a center that has a predominant focus on innovative sectors (e.g., food manufacturing, superconductors, and quantum information science). Further, the Department of Commerce must establish a regional innovation program to encourage and support the development of regional innovation strategies designed to increase innovation-driven economic opportunity within their respective regions. The bill also strikes provisions that progressively decrease the amount of financial assistance provided to a center over a term of years and subsequently cut the center's funding entirely after seven years, replacing them with a continuing five-year, metrics-based review of a center. Additionally, the bill (1) directs Commerce to collaborate with relevant federal departments and agencies when awarding financial assistance, and (2) authorizes Commerce to collaborate with stakeholders for the development of national certifications for advanced manufacturing workforce skills in the respective technology area of each center.
  • COVID–19 Emergency Manufacturing Act of 2020

    COVID-19 Emergency Manufacturing Act of 2020This bill establishes within the Department of Health and Human Services (HHS) an Emergency Office of Manufacturing for Public Health to manufacture and distribute medical products to address COVID-19 (i.e., coronavirus disease 2019) or medical products that are on shortage or vulnerable to shortage. The office must (1) obtain the rights to manufacture the applicable medicines, ingredients, diagnostic tests, medical devices, personal protective equipment, and supplies; (2) manufacture or contract to manufacture such items; and (3) construct, or enter into construction contracts for, facilities to manufacture certain medicines, such as vaccines. HHS may issue involuntary licenses allowing the office to make, use, sell, import, or export an invention related to an applicable drug, biological product, or device and to use clinical trial data and confidential information. Such a license must provide the rights holder with reasonable compensation. The office must (1) provide such COVID-19 products at no cost to federal, state, local, and other health programs and certain domestic health care providers and suppliers; (2) offer COVID-19 products at cost to other commercial and international entities; and (3) offer other medical products to entities at a fair price, based on cost and other considerations. The office shall prioritize the manufacture of certain COVID-19 products and meet manufacturing timelines specified in the bill.

    Manufactured Housing Community Sustainability Act of 2019 This bill amends the Internal Revenue Code to allow a business-related tax credit equal to 75% of the gain from the sale or exchange of real property to a qualified manufactured home community cooperative or corporation if  (1) the property is acquired for use as a manufactured home community, (2) the seller (or any related person) owned the property for the entire two-year period before the sale or exchange, and (3) the property is transferred subject to a binding covenant that the property will be used as a manufactured home community for at least 50 years or the maximum permissible term under state laws that restrict such covenants to a lesser term.. A "qualified manufactured home community cooperative or corporation" is a cooperative or a nonprofit corporation established pursuant to the laws of the state in which the property is located. The bill specifies membership and governance requirements for the communities owned by the cooperative or nonprofit corporation. The bill also imposes a tax on buyers who violate the covenant to use the property for manufactured housing.

    Foreign Manufacturers Legal Accountability Act of 2019 This bill requires a foreign manufacturer of products imported into the United States to establish a registered agent in the United States to accept service of process for regulatory proceedings or civil actions. Specifically, the bill requires specified agencies to implement regulations requiring a foreign manufacturer or producer to establish a registered agent who is authorized to accept process on behalf of the manufacturer or producer. The agent must be located in a state with substantial connection to the import, distribution, or sale of the product and, by registering an agent, the manufacturer or producer consents to the personal jurisdiction of the courts of that state. Additionally, the Department of Commerce must establish, maintain, and make publicly available a registry of such agents. The Department of Agriculture and the Food and Drug Administration must also jointly report on whether to require a foreign producer of imported food to register such an agent.

    Make It In America Manufacturing Communities Act This bill directs the Department of Commerce to establish the Manufacturing Community Support Program, under which certain consortiums shall be designated as manufacturing communities and receive specified support. To be eligible for designation, a consortium must include at least one (1) institution of higher education, (2) private sector entity, and (3) government entity. The consortium may define the region that it represents, as long as the region contains critical elements of key technologies or supply chain and enables close collaboration among the consortium's members. Each designation shall be for two years and may be renewed for up to two additional two-year periods. Support under the program shall include financial and technical assistance and preferential consideration when seeking such assistance. Designees may use such financial or technical assistance to support investments in ecosystems that will improve the competitiveness of U.S. manufacturing, including infrastructure, access to capital, promotion of exports and foreign direct investment, equipment upgrades, workforce training, energy or process efficiency, business incubators, site preparation, advanced research, supply chain development, and small business assistance.

    Modernizing Agricultural and Manufacturing Bonds Act This bill amends the Internal Revenue Code, with respect to qualified small issue bonds for manufacturing purposes, to expand the definition of "manufacturing facility" to include a facility that (1) is used in the creation or production of intangible property; or (2) is functionally related, subordinate to, and located on the same site as a facility used in the manufacturing or production of tangible or intangible personal property. The bill also increases from $10 million to $30 million the maximum bond size limitation. The bill also modifies requirements for private activity bond financing for first-time farmers. The modified provisions (1) increase from $450,000 to $552,500 (adjusted annually for inflation) the amount of bond proceeds that may be used by a first-time farmer to acquire land for farming purposes, (2) repeal the separate dollar limitation on the use of bond proceeds for used farm equipment, and (3) modify the definition of "substantial farmland" to determine farm size by reference to the average (instead of median) size of a farm in the county in which the farm is located.
