Contracting officers must give consideration to a contractor that provides comprehensive training and education programs to develop its workforce, consistent with the agency's needs. In assessing past performance, contracting officers must consider the manner in which an incumbent contractor is educating, investing, and retaining the contractor's workforce. Each agency shall develop workforce development investment incentives for contractors.

(The United States recognizes Juan Guaido as interim President of the legitimate government of Venezuela.) This bill provides exceptions, including for (1) contracts that the State Department determines to be in the national security interest of the United States, and (2) contracts that support U.S. government activities in Venezuela.

The report must include (1) information required in the initial report on recurring disaster response requirements; and (2) an updated strategy that defines the objectives of advance contracts, how such contracts contribute to FEMA disaster response operations, how to maximize the award of advance contracts to small business concerns, and whether and how such contracts should be prioritized in relation to new post-disaster contract awards. The bill sets forth additional duties of FEMA with respect to advance contracts, including requiring FEMA to (1) update and implement guidance for its program office and acquisition personnel to identify acquisition planning time frames and considerations across the entire acquisition planning process, and (2) communicate the purpose and use of a master acquisition planning schedule.

    Disaster Contract Transparency Act of 2019 This bill modifies the process for contracting following natural disasters. Specifically, the bill (1) requires state and local governments to have advance contracts in place for debris removal services in order to be eligible for the public assistance grant program; and (2) limits Federal Emergency Management Agency (FEMA) reimbursement of debris removal to the lower of federal, state, or local contract rates. The bill further requires FEMA to * penalize vendors for failing to adhere to pre-disaster contracts; * develop and implement clear rules regarding the oversight of debris removal contracts; * develop a documented risk-based approach for grants that federal coordinating officers can use to determine appropriate cost-effective field presence required for debris removal oversight; and * report to Congress annually detailing a comprehensive list of advance contracts and a review of the need for advance contracts that may be lacking for debris removal and other services.

    Contracting and Tax Accountability Act of 2019 This bill prohibits an executive agency from awarding a contract or grant in excess of the simplified acquisition threshold unless the prospective contractor or grantee certifies in writing to the agency awarding the contract or grant that the contractor or grantee has no seriously delinquent tax debt.Simplified acquisition thresholdmeans the dollar amount below which a nonfederal entity may purchase property or services using small purchase methods. The bill (1) authorizes the Department of the Treasury to disclose to an agency whether such person has a seriously delinquent tax debt, and (2) subjects a person with such debt to suspension or debarment from the federal procurement process. The bill definesseriously delinquent tax debtas a federal tax liability that has been assessed by the Internal Revenue Service and is collectible by levy or a court proceeding, with exceptions for a tax debt (1) that is being paid in a timely manner under an approved installment agreement or an offer-in-compromise, (2) for which a collection due process hearing has been requested or is pending, (3) for which a continuous levy has been issued or agreed to by an applicant for employment, or (4) with respect to which such a levy is released because it has been determined to be an economic hardship to the taxpayer.

    United States Export Finance Agency Act of 2019 This bill reauthorizes the U.S. Export-Import Bank through FY2029 and otherwise modifies its operations. Specifically, the bill redesignates the bank as the United States Export Finance Agency and increases its lending cap over the period of its reauthorization. In the event of a quorum lapse, the bill provides for the establishment of a temporary board to act in the stead of the Board of Directors. The bill also prohibits the agency from providing financing for certain specified entities and persons involved in sanctionable activities. Additionally, the agency must establish (1) the Office of Minority and Women Inclusion to increase the participation of such groups in the agency's programs and contracts; (2) the Office of Territorial Exporting to promote the export of goods and services from U.S. territories; and (3) the Office of Financing for Renewable Energy, Energy Efficiency and Energy Storage Exports to promote exports used in the production of renewable energy resources and energy efficiency technologies. Further, the agency is authorized to (1) deem as met certain prerequisite considerations to providing competitive export financing in the case of exports likely to be supported by official financing from China; and (2) establish a program under which it may enter into arrangements (i.e., reinsurance pools) to share risks associated with the extension of credit.
