Generally, Buy American requires agencies to procure domestic goods. The bill requires (1) the Department of Commerce to report periodically to Congress and the President on the implementation of, and compliance with, Buy American laws; (2) Commerce and the Office of the U.S. Trade Representative to assess the impacts of all U.S. free trade agreements and the World Trade Organization Agreement on Government Procurement on the operation of such laws; and (3) the General Services Administration (GSA) to establish a free, publicly available BuyAmerican.gov website. Public interest waivers from Buy American laws shall be construed to ensure the maximum utilization of goods, products, and materials produced in the United States. The President shall develop a mechanism to collect information on requests to waive Buy American laws and other domestic content restrictions for purposes of providing early notice to possible waivers via the website. Executive agencies shall make information concerning the intention to issue a waiver or exception in connection with a federal procurement available to the GSA at least 20 days prior to waiving a Buy American law. The Government Accountability Office shall report to Congress within two years of this bill's enactment describing the bill's implementation.

    American Food for American Schools Act of 2019 This bill requires school food authorities (SFAs) to request a waiver from the Department of Agriculture (USDA) to purchase foreign commodities or products for the National School Lunch Program (NSLP). SFAs may purchase foreign commodities or products without a waiver if the commodities or products are not produced or available domestically. (Under current law, Buy American provisions require SFAs to purchase, to the maximum extent practicable, domestic commodities or products for the NSLP. There are limited exceptions which permit the purchase of foreign products in circumstances when using domestic products is truly not practicable. If an SFA uses an exception, there is no requirement to request a waiver to purchase a foreign product or commodity, but the SFA must keep documentation justifying the exception.) USDA may not provide a waiver for an SFA to purchase foreign commodities or products unless (1) the commodities or products are not produced domestically in sufficient amounts or of satisfactory quality, (2) the domestic commodities or products would be significantly higher in price than foreign commodities or products, and (3) the SFA agrees to make the waiver publicly available on its website and email a notification of the waiver to parents or guardians of students who will be served the foreign commodity or product purchased pursuant to the waiver.

    Buy America 2.0 Act This bill prohibits federal funding of a transportation or infrastructure project unless the steel, iron, and manufactured goods used for the project are produced in the United States, except where (1) inconsistent with the public interest; (2) iron, steel, and the relevant manufactured goods are not produced in the United States in sufficient and reasonably available quantities and of a satisfactory quality; or (3) inclusion of iron, steel, and manufactured goods produced in the United States will increase the cost of the overall project by more than 25%. The bill revises and expands Buy America provisions pertaining to public transportation, rail loan and loan guarantees, and aviation. The bill permanently extends the prohibition on the use of funds for a public water system project that does not use iron and steel products produced in the United States.

The CMS must also award grants to states and nonprofit organizations for outreach and enrollment activities relating to the buy-in option. The bill also (1) establishes a supplemental option under Medicare to cover cost-sharing for beneficiaries; (2) repeals provisions that prohibit the CMS from negotiating the prices of prescription drugs; and (3) establishes an individual market reinsurance program relating to coverage of high-cost individuals, as specified.

Each agency shall ensure that none of the funds made available for such a program may be used for a project unless all of the iron, steel, and manufactured products used in the project are produced in the United States, subject to waivers where inconsistent with the public interest, where not produced in sufficient quantities or satisfactory quality, or where such inclusion will increase the cost of the project by more than 25%.
