It also provides for enforcement by the Federal Trade Commission, preempts state laws relating to endorsement or agency contracts, and establishes the Covered Athletic Organization Commission.

The bill also (1) prohibits certain activities of institutions, boosters, and third-party licensees relating to athlete classification, scholarships, and contracts; and (2) directs the Federal Trade Commission to oversee all activities and approve all rules issued by a private, independent, and nonprofit entity responsible for developing and administering NIL rules concerning student athletes and specified others.

    College Athlete Pandemic Safety Act This bill requires institutions of higher education (IHEs) to take certain health and safety actions to respond to COVID-19 (i.e., coronavirus disease 2019), specifically for college athletes. Specifically, the bill prohibits IHEs from (1) allowing any individual to agree to a liability waiver for any sporting activity, or (2) canceling a scholarship or any other financial aid provided to a college athlete who does not participate in team activities due to concerns about COVID-19. Further, each IHE must inform its college athletes when a college athlete or a staff member of its athletic department tests positive for COVID-19, without revealing any personally identifiable information about the individual. Additionally, the Centers for Disease Control and Prevention must, within 90 days, develop health and safety guidelines related to COVID-19 for athletic departments of IHEs. IHEs must comply with these guidelines. The bill also provides a private right of action for individuals affected by violations of the bill.

The bill provides for an annual amateur athlete survey conducted anonymously and an Athletes' Advisory Council. The bill revises duties of the Office of the Ombuds regarding the pursuit of abuse claims by the U.S. Center for SafeSport, confidentiality, and retaliation against an employee or member for disclosing information or seeking assistance in mediation. The USOPC and the national governing bodies shall not interfere in or attempt to influence the outcome of an investigation. The center shall report to Congress within 72 hours of an attempt to interfere in, or influence the outcome of, an investigation. The bill establishes within the legislative branch the Commission on the State of U.S. Olympics and Paralympics to study matters relating to the state of U.S. participation in the Olympic and Paralympic Games. The bill prohibits retaliation against protected individuals (including amateur athletes, coaches, and trainers) because of disclosures pertaining to sexual abuse or harassment.

    Student and Student Athlete Opioid Misuse Prevention ActThis bill authorizes the Substance Abuse and Mental Health Services Administration (SAMHSA) to provide grants to support addiction-prevention and prescription-drug-misuse programs related to opioids and other medications used for pain or injury recovery. Specifically, SAMHSA may award grants to eligible public and nonprofit private entities, including states and drug-free community coalitions, to carry out such programs in schools, athletic programs, and communities. Among other activities, grant recipients may use funds to educate teachers, campus-based medical providers, and others on signs of opioid misuse and options for treatment and prevention. In addition, SAMHSA must report annually on federal programs to prevent pain medication misuse and addiction.

    Protecting Student Athletes From Concussions Act of 2020 This bill conditions each state's receipt of federal funds, beginning in FY2021, on the state's enforcement of specified minimum requirements for the prevention and treatment of concussions in school-sponsored athletics and activities. Each local educational agency must develop and implement a standard plan for concussion safety and management that includes (1) the education of students, parents, and school personnel about concussions; (2) specified supports for each student recovering from a concussion; and (3) best practices designed to ensure the uniformity of safety standards, treatment, and management. Each public school must post on school grounds and publish on the school website specified information about concussions. If any public school personnel suspects that a student has sustained a concussion during a school-sponsored activity, the student must be immediately removed from participation in that activity and prohibited from participating in any school-sponsored athletic activities until the student submits a written release from a health care professional. Furthermore, the school personnel must report all available information regarding the injury to a concussion management team that will confirm and report details of the injury to the student's parents. The school's concussion management team shall consult with and make recommendations to relevant school personnel and the student to ensure that the student is receiving the appropriate academic supports.
