Bill Summary
This legislation, known as the "No CORRUPTION Act," seeks to amend the United States Code to prevent Members of Congress who have been convicted of certain offenses from receiving pension payments while incarcerated. Under this Act, any Member of Congress who is convicted of such offenses will forfeit their right to receive any pension payments based on their service as a Member. However, if the conviction is overturned on appeal, the individual will be eligible to receive the payments they would have received had they not been incarcerated. This Act only applies to convictions that occur after its enactment date. Additionally, a technical and conforming amendment is made to another section of the United States Code to reflect these changes. This legislation was passed by both the House of Representatives and the Senate and was signed into law by the President.
Possible Impacts
1. A Member of Congress is convicted of a felony offense and is no longer eligible to receive their pension payments under this Act. This could have a significant financial impact on the individual and their family, as they may have relied on this pension for their retirement plans.
2. If the conviction is overturned on appeal, the individual will still receive their pension payments, but they may have gone without these payments for a period of time. This could create financial strain for the individual during that period.
3. The Act only applies to convictions that occur after its enactment, so individuals convicted of offenses prior to the Act's passage will still be eligible to receive their pension payments. This could create a disparity between those affected by the Act and those who are not, potentially causing controversy and debate.
