RES. 493 Impeaching President Joseph Robinette Biden, President of the United States, for high crimes and misdemeanors. _______________________________________________________________________ IN THE HOUSE OF REPRESENTATIVES June 12, 2023 Mr. Ogles (for himself and Mrs. Miller of Illinois) submitted the following resolution; which was referred to the Committee on the Judiciary _______________________________________________________________________ RESOLUTION Impeaching President Joseph Robinette Biden, President of the United States, for high crimes and misdemeanors. Resolved, That Joseph Robinette Biden, President of the United States, is impeached for high crimes and misdemeanors and that the following articles of impeachment be exhibited to the United States Senate: Articles of impeachment exhibited by the House of Representatives of the United States of America in the name of itself and of the people of the United States of America, against Joseph Robinette Biden, President of the United States, in maintenance and support of its impeachment against him for high crimes and misdemeanors. article i In his conduct of the Office of President of the United States, Joseph Robinette Biden, in violation of his constitutional oath to faithfully execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, has prevented, obstructed, and impeded the administration of justice, in that: Joseph Robinette Biden has weaponized the Executive Office of the President and his years of service in the White House, to include his service as Vice President, to shield the business and influence peddling schemes of his family from congressional oversight and public accountability. His conduct has included the following: (1) A failure to comply with numerous congressional requests for information and documentation, violating a personal commitment to transparency. Members of Congress had sent numerous oversight requests and inquiries to key officials within the Biden administration in furtherance of Congress' constitutional oversight obligations. These requests included a letter to Secretary Yellen, requesting Suspicious Activity Reports for the Biden family and business associates, a letter to the Director of the Federal Bureau of Investigation, Christopher Wray, requesting information about Hunter Biden's connection to members of the Chinese Communist Party, and a letter to then Acting Archivist of the United States, Debra Steidel Wall, regarding the Biden family's use of Air Force Two to facilitate business transactions with Chinese nationals. (2) Several companies created after January 20, 2017, by Biden family members and the business associates of those family members were established as limited liability companies; these companies and others were used to funnel millions of dollars to Biden family members in intricate financial webs intended to deceive the public and obscure the sources of those funds. In early 2017, the Biden family received $1,065,000 in payments over a 3-month period from Rob Walker, a family associate; those funds were part of a larger $3,000,000 payment from State Energy HK Limited (a Chinese company) to Rob Walker's company. (3) In 2016, then-Vice President Biden told then-Ukrainian President Petro Poroshenko that the United States would rescind $1,000,000,000 in loan guarantees unless the Ukrainian President fired Prosecutor General Viktor Shokin. Mr. Shokin was investigating Burisma Holdings at the time, a Ukrainian company that paid Hunter Biden more than $50,000 a month to sit on its Board. (4) The Biden administration withheld a critical FD-1023 form until threatened with a congressional subpoena. The FD- 1023 form, made available to the Members of the House Oversight and Accountability Committee in June 2023, reportedly details a bribery scheme in which members of the Biden family, including Joseph Robinette Biden, received $5,000,000 each to assist Burisma Holdings. The confidential human source of this form has been used by the Federal Bureau of Investigation as a reliable source of information since 2010. In all of this, Joseph Robinette Biden has acted in a manner contrary to the public trust and subversive of constitutional government, to the great prejudice of the cause of law and justice and to the manifest injury of the people of the United States. Wherefore Joseph Robinette Biden, by such conduct, warrants impeachment and trial, removal from office, and disqualification to hold any enjoy any office of honor, trust, or profit under the United States. article ii In his conduct of the office of President of the United States, Joseph Robinette Biden, contrary to his oath faithfully to execute the office of President of the United States and, to the best of his ability, preserve, protect, and defend the Constitution of the United States, and in violation of his constitutional duty to take care that the laws be faithfully executed, directly facilitated the ongoing southern border crisis and endangered the people of the United States, in that: (1) In the first five months of fiscal year 2023, 106,000 pounds of drugs were seized at the southwest border, including 11,000 pounds of fentanyl. The first five months of fiscal year 2023 saw a 179.3-percent increase in fentanyl seizures over the same time frame in fiscal year 2022. (2) The U.S. Customs and Border Protection Agency ``encountered'' 251,978 illegal aliens at the southwest border in December 2022, the highest monthly total ever recorded; this represented 10 consecutive months of over 200,000 illegal alien ``encounters''. (3) Despite these large numbers, Joseph Robinette Biden refuses to utilize powers provided to the President by Congress, specifically those described in section 1182(f) of title 8, United States Code. (4) Since the creation of the Department of Homeland Security, the number of monthly ``encounters'' had never crossed the 200,000 threshold; the Biden administration is responsible for the 6 highest and 8 of the 10 highest months ever recorded. (5) The ongoing border crisis has inflicted harrowing costs on the welfare of women and children. The number of unaccompanied alien children ``encountered'' by the U.S. Customs and Border Protection Agency at the southwest border in fiscal year 2017 was 48,681. In fiscal year 2022, that number stood at 152,057, a 212-percent increase. Hundreds of thousands of vulnerable children have been ``encountered'', trafficked, and smuggled across the southwest border in the 2 years since President Biden took office, representing hundreds of children every day. (6) Due to rampant drug trafficking at our southern border, the leading cause of death for Americans aged 18-45 can now be attributable to fentanyl overdoses; in 2020 and 2021, fentanyl was responsible for killing more Americans in this age group than COVID-19, car accidents, cancer, and suicide. In all of this, Joseph Robinette Biden has acted in a manner contrary to the public trust and subversive of constitutional government, to the great prejudice of the cause of law and justice and to the manifest injury of the people of the United States. Wherefore, Joseph Robinette Biden, by such conduct, warrants impeachment and trial, removal from office, and disqualification to hold any enjoy any office of honor, trust, or profit under the United States. <all>
