Bill Summary

This legislation, known as the "SAFE Workers Act" or "Secure and Fair Elections for Workers Act", directs the National Labor Relations Board (NLRB) to implement a system and procedures for conducting representation elections remotely using an electronic voting system. This means that employees will have the option to vote in union elections using either an internet or telephone voting system, instead of through traditional mail-in ballots. If the NLRB does not implement this system within 60 days, they will use the system and procedures of the National Mediation Board. In the interim period before the electronic voting system is implemented, all representation elections will be conducted by mail ballot. The NLRB must also submit reports to Congress every 90 days on the elections they have conducted and the cost of using the new system. This legislation will only apply during the COVID-19 public health emergency and will be funded with $1 million. Additionally, this legislation also amends the Further Consolidated Appropriations Act of 2020 by striking a section related to union elections.

Possible Impacts

1. This legislation could affect workers by ensuring their right to vote in representation elections remotely, making it easier and more accessible for them to participate in the election process.

2. The use of electronic voting systems could also potentially increase voter turnout and representation for workers who may have difficulty physically attending in-person elections due to health or logistical reasons.

3. The cost of conducting elections through this system could also impact taxpayers, as the legislation includes an authorization of $1,000,000 in funds for the National Labor Relations Board to implement the system and procedures.
