Bill Summary

This bill, known as the "Justice for Native Survivors of Sexual Violence Act," seeks to amend the Indian Civil Rights Act of 1968 in order to expand the jurisdiction of tribal courts. This would allow tribal courts to handle cases involving sexual violence, sex trafficking, and stalking that occur on Indian land. The bill also includes definitions for terms such as "related conduct," "sex trafficking," "sexual violence," and "stalking." This bill aims to provide justice for Native survivors of sexual violence and increase the authority of tribal courts in addressing these crimes.

Possible Impacts

1. The Justice for Native Survivors of Sexual Violence Act would provide jurisdiction for tribal courts to prosecute crimes involving sexual violence, thus potentially affecting survivors of sexual violence by providing them with access to justice and potentially increasing their safety through the prosecution and punishment of offenders.

2. This legislation could also affect Indigenous communities by potentially providing them with more control over their own justice system and the ability to hold perpetrators of sexual violence accountable within their own communities.

3. The amendment of the Indian Civil Rights Act could also potentially impact non-Native individuals who commit crimes of sexual violence on tribal lands, as they would now be subject to tribal jurisdiction and prosecution for their actions.
