Bill Summary

This bill aims to provide a safe transit exception for Department of Defense (DoD) aircraft flying over designated wilderness areas in Colorado. It allows for deviations from service level requirements, such as oxygen levels, icing, engine power limitations, cloud clearance, and turbulence, if they prevent safe transit through these areas. The Secretary of Defense is responsible for ensuring that all DoD regulations and flight procedures comply with this exception. This legislation aims to balance the need for military operations with the protection of wilderness areas.

Possible Impacts

1. The individuals living in the designated wilderness areas in Colorado may experience disruptions and loud noises from military aircraft flying overhead, as the legislation allows for exceptions to service level requirements.
2. Residents in the wilderness areas may also be concerned about potential safety risks from military aircraft deviating from service level requirements, as determined by the Secretary of Defense.
3. The military personnel operating the aircraft may face added pressure and difficulties in navigating the wilderness areas, as they are required to deviate from service level requirements in order to safely transit the designated areas.

                     areas, and for other purposes.

Be it enacted by the Senate and House of Representatives of the

              WILDERNESS AREAS.

    (a) In General.--Military aircraft operating outside of designated
Department of Defense airspace in the wilderness areas in the
mountainous regions of Colorado may deviate from service level
requirements if oxygen requirements, icing levels, engine power
limitations, cloud clearance, or turbulence prevent such aircraft from

level requirements, as determined by the Secretary of Defense.
    (b) Regulations.--The Secretary of Defense shall ensure that all
Department of Defense regulations and flight procedures are in
accordance with subsection (a).
